1. Acceptance of Terms & Eligibility
By accessing or using Kill TV (the "Platform"), you agree to these Terms of Service ("Terms"). If you do not agree, you must immediately discontinue use of the Platform.
Kill TV is operated by Kodacore LLC and is strictly limited to individuals who are at least eighteen (18) years of age. By accessing or using the Platform, you represent and warrant that:
- You are at least 18 years old;
- You are legally permitted to access adult, explicit, or graphic material in your jurisdiction;
- You access the Platform voluntarily and at your own initiative;
- You are solely responsible for determining whether your access or use complies with applicable local, state, national, or international law; and
- You agree to the binding arbitration and class action waiver provisions set forth in Section 13.
The Platform may contain graphic, violent, sexually explicit, disturbing, or otherwise emotionally distressing material, including real-world documentation and fictional depictions. Viewer discretion is advised.
By accessing or using the Platform, you acknowledge the nature of such content, voluntarily assume all risks associated with viewing it, and waive, to the fullest extent permitted by law, any claim arising from emotional distress, psychological harm, or offense.
Your electronic acceptance of these Terms constitutes a legally binding electronic signature and forms a binding agreement between you and Kodacore LLC.
2. Platform Status & Authority
Kill TV is a U.S.-based digital marketplace and interactive computer service.
Content is uploaded by independent third-party users ("Users") and creators ("Merchants"). Kill TV does not create, produce, direct, or materially contribute to user-generated content. All content decisions regarding user-generated content are made solely and independently by Users and Merchants.
Kill TV operates under 47 U.S.C. § 230 and is not the publisher or speaker of user-submitted content. Moderation, removal, ranking, monetization, or enforcement decisions are undertaken in good faith to enforce these Terms and applicable law, and do not create publisher liability or transform Kill TV into the creator or developer of any content. Kill TV's exercise of a traditional editorial function—such as removing objectionable content or restricting access—does not strip Kill TV of its status as a neutral platform under Section 230.
Kill TV may, at its sole discretion and without notice:
- Remove or restrict content
- Suspend or terminate accounts
- Withhold, reverse, offset, or permanently forfeit funds
- Investigate suspected violations
- Preserve identifying logs
- Cooperate with law enforcement
- Modify platform functionality
Kill TV does not assume a duty to monitor content. Enforcement actions are discretionary and do not create a duty of care or special relationship.
2.1 Licensed & Distributed Content
In addition to user-generated content, Kill TV may offer content obtained through licensing, distribution, or syndication agreements with third-party producers, distributors, or rights holders ("Licensed Content"). Kill TV's selection, promotion, featuring, or scheduling of Licensed Content does not make Kill TV the producer, co-producer, creator, or developer of such content.
All production-related legal obligations for Licensed Content—including but not limited to compliance with 18 U.S.C. § 2257, performer age verification, recordkeeping, and maintenance of a designated records custodian—remain solely with the original producer, production company, or distributor that created or holds such obligations under applicable law. Kill TV does not assume, inherit, or share any production-related compliance obligations by virtue of licensing, distributing, promoting, or making available any Licensed Content on the Platform.
Kill TV's promotion, featuring, advertising, or editorial placement of Licensed Content constitutes distribution and marketing activity only and does not constitute editorial control over the substance of such content. Such activity does not alter Kill TV's status under 47 U.S.C. § 230 with respect to user-generated content hosted on the Platform.
2.2 Parental Control Tools (230(d) Notice)
In accordance with 47 U.S.C. § 230(d), you are advised that parental control tools are commercially available that may assist in limiting access to material that may be harmful to minors. Examples of such tools include: CYBERsitter™, Net Nanny®, CyberPatrol, and ASACP.
3. Accounts
You are responsible for all activity under your account and must maintain accurate information. You may not:
- Impersonate others
- Circumvent safeguards
- Use bots or automated abuse
- Engage in fraud
- Share or sell accounts
Kill TV may suspend or terminate accounts associated with violations, fraud, or chargebacks.
3.1 Account Termination & Forfeiture
If Kill TV terminates your account for any violation of these Terms, all Koins, credits, balances, and any associated value in your account are immediately and permanently forfeited. You acknowledge that terminated accounts are not entitled to any refund, credit, conversion, or compensation of any kind.
If you voluntarily close your account, any remaining Koins, credits, or balances are forfeited upon closure. Koins are platform-issued digital credits with no cash value and cannot be refunded, transferred, or converted to currency upon account closure.
4. Age Verification
Kill TV implements age verification measures for users located in jurisdictions within the United States that require age verification for access to adult or explicit content.
If you access the Platform from an IP address associated with a jurisdiction that mandates age verification, you will be required to complete an identity verification process before accessing restricted content. This process requires you to:
- Upload a valid government-issued photo identification document; and
- Submit a live photograph of yourself alongside your account for identity matching purposes.
Kill TV processes age verification data solely for the purpose of compliance with applicable U.S. age verification laws. Handling, storage, and deletion of verification data is governed by our Privacy Policy.
Kill TV is a United States-based platform operated under United States law. Kill TV's age verification obligations are limited to compliance with applicable U.S. federal and state laws. Kill TV does not undertake age verification for users accessing the Platform from outside the United States and makes no representation that the Platform complies with the laws of any foreign jurisdiction. Users located outside the United States access the Platform at their own initiative and are solely responsible for ensuring their access and use complies with all applicable laws in their jurisdiction, including any age verification, content restriction, or data protection requirements.
Attempting to circumvent, bypass, or otherwise defeat age verification measures—including but not limited to the use of VPNs, proxies, or falsified identification—constitutes a material violation of these Terms and may result in immediate account termination, forfeiture of any Koins or funds, and referral to law enforcement where applicable.
5. User & Merchant Responsibilities; 18 U.S.C. § 2257 Compliance
All Users and Merchants are solely responsible for ensuring that their content complies with all applicable United States federal and state laws. Users and Merchants located outside the United States are additionally responsible for compliance with the laws of their own jurisdiction.
If you upload sexually explicit content, you represent and warrant that you are the "primary producer" as defined under 18 U.S.C. § 2257 and its implementing regulations.
You are solely responsible for:
- Verifying that all performers are at least 18 years of age
- Maintaining legally required age-verification records
- Maintaining written consent and release documentation
- Producing such records if lawfully requested by authorities, and maintaining a designated records custodian and inspection address as required by 28 C.F.R. § 75.6
Kill TV is not the producer (primary or secondary) of user-submitted content and does not create, direct, control, or otherwise participate in the production of such content. Kill TV is an interactive computer service as defined under 47 U.S.C. § 230(f) and an internet access service as defined under 47 U.S.C. § 231(e), and is exempt from being considered a producer under 18 U.S.C. § 2257(h)(2)(B). Kill TV does not maintain, receive, or have custody of any 18 U.S.C. § 2257 records. All such records are maintained by the respective primary producers of such content, and all recordkeeping and custodian obligations rest solely with the uploading User or Merchant as the primary producer.
For collaborative content, you are solely responsible for obtaining participant consent, maintaining documentation, and managing any revenue distribution between participants. You agree that Kill TV is not responsible for disputes arising between collaborators.
6. Prohibited Content
For purposes of these Terms, "content" includes any material uploaded, posted, transmitted, or shared on or through the Platform, including but not limited to videos, images, audio, text, comments, messages, direct messages, live streams, profile information, and any other user-generated or user-submitted material.
You may not upload or distribute content that violates applicable United States federal or state law, including but not limited to content that:
- Involves real minors in any sexual context
- Depicts non-consensual sexual conduct involving real persons
- Depicts real sexual conduct between humans and animals
- Involves actual unlawful cruelty, torture, or serious bodily injury to real animals
- Is unlawfully recorded, obtained, or distributed
- Infringes intellectual property rights
- Facilitates, promotes, or materially assists real-world trafficking, coercion, fraud, or criminal activity
- Publishes private residential addresses, financial data, or non-public personal identifying information without authorization
- Engages in real-world impersonation of law enforcement or public officials for unlawful purposes
- Contains direct incitement to imminent real-world violence or unlawful acts
Fictional or simulated depictions involving consenting adults are permitted if lawful. You are solely responsible for compliance.
7. Copyright Policy (DMCA)
Kill TV complies with the Digital Millennium Copyright Act, 17 U.S.C. § 512.
If you believe that content available on the Platform infringes your copyright, you must submit a notification in accordance with the DMCA and our published DMCA Policy.
Upon receipt of a compliant notice, Kill TV may remove or disable access to the allegedly infringing material and may terminate repeat infringers in appropriate circumstances.
Users and Merchants may submit counter-notifications as permitted under 17 U.S.C. § 512. Knowingly submitting materially false claims or counter-notifications may result in liability under 17 U.S.C. § 512(f).
8. Koins & Payments
Koins are platform-issued digital credits that grant a limited license to access or unlock content on Kill TV. All Koins purchased or earned on the Platform are subject to the following conditions:
- Have no cash value
- Are non-transferable
- Cannot be withdrawn or redeemed for currency
- Are non-refundable
- Do not constitute currency, stored value, securities, financial instruments, or deposits
Koins may be purchased in fixed packages. The purchase price of Koins includes all applicable platform fees. No separate platform fee is charged at the time Koins are spent.
All Koin purchases are final.
Kill TV retains sole discretion to manage, modify, suspend, or discontinue the Koin system at any time.
Kill TV may reverse, offset, or withhold earnings arising from disputed, fraudulent, or chargeback-related transactions.
Kill TV uses third-party payment processors and does not store full financial credentials. Cryptocurrency transactions are irreversible. Kill TV is not responsible for exchange volatility, wallet errors, private key loss, network delays, or blockchain-related failures.
Kill TV may perform internal cryptocurrency conversions solely for internal treasury management, stabilization, and operational purposes. Such conversions are internal to Kill TV's operations and do not constitute money transmission, exchange services, or financial services offered to users.
Users and Merchants are solely responsible for determining and paying any applicable taxes unless required by law to be collected by Kill TV.
8.1 Payment Disputes
If you believe a payment or transaction was processed incorrectly, you must contact [email protected] within 30 days of the transaction with a detailed explanation. Failure to report the issue within that timeframe constitutes a waiver of your right to dispute the transaction.
9. Disclaimers
The Platform is provided "as is" and "as available."
Kill TV makes no warranties regarding availability, legality in every jurisdiction, accuracy, or uninterrupted access.
Kill TV is not responsible for:
- User-generated content
- User conduct
- Emotional distress
- Data loss
- Cyber incidents
- Payment processor errors
- Blockchain events
Your sole remedy is to stop using the Platform.
10. Limitation of Liability
To the fullest extent permitted by law, Kill TV's total liability shall not exceed $100 USD or the amount you paid in the preceding 12 months, whichever is greater.
11. Indemnification
You agree to defend, indemnify, and hold harmless Kill TV, its owners, affiliates, officers, employees, contractors, and agents from any claim, liability, loss, damage, judgment, settlement, fine, penalty, cost, or expense (including attorneys' fees, expert fees, investigative costs, and regulatory fines) arising from:
- Your use of the Platform
- Your content
- Your violation of law
- Your breach of these Terms
- Any investigation or enforcement action resulting from your conduct
This obligation survives termination.
12. Release
You release Kill TV from claims arising from:
- User disputes
- Collaborative content disputes
- Off-platform conduct
- Content that complies with these Terms but you find objectionable
13. Dispute Resolution & Arbitration
All disputes arising out of or relating to these Terms or your use of the Platform shall be resolved exclusively through binding arbitration administered by the American Arbitration Association (AAA). Disputes involving claims of $75,000 or less shall be governed by the AAA Consumer Arbitration Rules. Disputes involving claims exceeding $75,000 shall be governed by the AAA Commercial Arbitration Rules.
You waive:
- Jury trial rights
- Class actions
- Representative proceedings
The arbitrator has exclusive authority to determine enforceability of this arbitration provision and may award relief available in court. Dispositive motions are permitted.
All arbitration proceedings shall be conducted virtually unless otherwise agreed by both parties in writing. To the extent in-person proceedings are required, such proceedings shall take place in Clark County, Nevada.
Small Claims Exception. Notwithstanding the foregoing, either party may bring an individual action in small claims court located in Clark County, Nevada, provided the claim falls within that court's jurisdictional limits. If the claim is removed or transferred from small claims court, it shall proceed in binding arbitration as described above.
14. Privacy Policy
Your use of the Platform is also governed by our Privacy Policy. The Privacy Policy describes how Kill TV collects, uses, stores, and discloses your personal information, including any data submitted during the age verification process described in Section 4.
By using the Platform, you acknowledge that you have read and understood the Privacy Policy and consent to the collection, use, and disclosure of your information as described therein.
The Privacy Policy is incorporated into and forms part of these Terms. In the event of a conflict between these Terms and the Privacy Policy, these Terms shall control.
15. Miscellaneous
Modification of Terms. Kill TV reserves the right to modify, update, or revise these Terms at any time and at its sole discretion. Updated Terms will be posted on the Platform with a revised "Effective Date." It is your responsibility to review the Terms periodically. Your continued use of the Platform after any changes constitutes your acceptance of the revised Terms. If you do not agree with the updated Terms, your sole remedy is to discontinue use of the Platform.
Force Majeure. Kill TV is not liable for delays or failure to perform resulting from events beyond its reasonable control, including cyber incidents, payment processor failures, regulatory action, infrastructure outages, natural disasters, labor disputes, war, governmental restrictions, or service provider disruptions.
No Reliance. You acknowledge that you have not relied on any representation, warranty, statement, or promise not expressly set forth in these Terms.
Entire Agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Kill TV regarding use of the Platform and supersede all prior discussions, proposals, emails, or agreements, whether written or oral.
Assignment. Kill TV may assign or transfer its rights and obligations without restriction. You may not assign your rights without prior written consent.
No Waiver. Failure to enforce any provision shall not constitute a waiver of any right.
Severability. If any provision is held unenforceable, the remaining provisions remain in full force and effect.
Electronic Communications. You consent to receive electronic communications, notices, and account-related communications. Electronic delivery satisfies any legal notice requirement.
Export Compliance. You agree to comply with applicable export control and sanctions laws and represent that you are not located in, or acting on behalf of, a restricted or sanctioned jurisdiction.
Survival. Provisions relating to enforcement, indemnification, limitation of liability, arbitration, ownership rights, and payment reversals survive termination.
No Third-Party Beneficiaries. These Terms do not create any third-party beneficiary rights.
Headings. Headings are for convenience only and do not affect interpretation.
Governing Law. These Terms are governed by the laws of the State of Nevada and the United States, without regard to conflict-of-law principles.
